Welcome to BK KRAFT. The terms “we”, “us” and “our” refer to Bk Kraft. We operate this online boutique, including all related information, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 2 - OUR PRODUCTS We have made every effort to display as accurately as possible the colors and images of our leather goods. We cannot guarantee that your computer monitor's display of any color (such as our Oxblood or Coffee Brown) will be entirely accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.
SECTION 3 - ORDERS When you place an order, you are making an offer to purchase. BK Shop reserves the right to accept or decline your order for any reason. Your order is not accepted until we confirm it and process your payment. Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy. You represent and warrant that your purchases are for personal or corporate gifting use, and not for unauthorized commercial resale.
SECTION 4 - PRICES AND BILLING Prices for our products are subject to change without notice. Unless otherwise expressly stated, posted prices are inclusive of applicable Kenyan VAT, but may not include shipping or courier dispatch charges, which will be calculated at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
SECTION 5 - SHIPPING AND DELIVERY While we strive for prompt dispatch, all delivery times are estimates. We are not responsible for delays caused by third-party corporate couriers (e.g., Fargo Courier, G4S, or local riders) or events outside our control. Once we transfer products to the carrier, the risk of loss passes to you.
SECTION 6 - INTELLECTUAL PROPERTY Our Services, including all brand names, logos, product designs, images, and text, are owned by BK Kraft (trading as BK Kraft) and are protected by Kenyan and international copyright, trademark, and intellectual property laws. You must not reproduce, distribute, modify, or create derivative works of any material on our site without our prior written consent.
SECTION 7 - OPTIONAL TOOLS & THIRD-PARTY LINKS We may provide you with access to third-party tools (such as payment gateways like Paystack) over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools “as is” without any warranties. Complaints or concerns regarding third-party services should be directed to the third party.
SECTION 8 - RELATIONSHIP WITH SHOPIFY BK Shop is powered by Shopify. However, any sales and purchases you make in our store are made directly with BK Kraft. By using the Services, you expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with us.
SECTION 9 - PRIVACY POLICY Your submission of personal information through the store is governed by our Privacy Policy. Because our store is hosted by Shopify, your data is securely processed in accordance with their infrastructure.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL BK SHOP, DANCO LIMITED, OUR DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.
SECTION 13 - INDEMNIFICATION You agree to indemnify, defend and hold harmless BK Kraft, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service.
SECTION 14 - SEVERABILITY & WAIVER If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. SECTION 15 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Nairobi.
